TCPA Compliance FAQ

What is TCPA Compliance?

The Telephone Consumer Protection Act (“TCPA”) is a United States law designed to protect consumers from auto-dialed calls and robo-calls. For the TCPA to apply to the calls, the call’s purpose must be for marketing and advertising. The TCPA was later updated to include text-messaging as a form of auto-created communication that the TCPA protects against. A built-in exception of the TCPA allows: “non-autodialed text messages do not require the message recipient’s consent if the message in question is information in nature.”

Under TCPA regulations, the Whisp.IO designed text messaging sequence with consumers is fully compliant due to the following reasons:

  1. Whisp.IO's text messaging system does not have the ability to generate phone numbers and requires human intervention (the consumer must actively provide their cell number). Because of these reasons, Whisp.IO's system is not an auto-dialer for the TCPA.

  2. Messages sent in direct response to a consumer request for information are considered “Informational” and the TCPA does not apply.

  3. The Consumer must consent to the text sequence by clicking through the widget and providing their cell-phone number. The text messaging sequence also allows for Opt-out (by texting “Stop”) at every level to further allow for consumer consent and opt-out.

Privacy

The privacy of consumer information is important to Whisp.IO. We will never sell or transmit the consumer data received through the Whisp.IO processes. The information obtained from the consumer and about the consumer is transferred directly to our clients CRM or data repository for use in their system. When a consumer’s data is obtained it is protected under both Whisp.IO privacy policy (link) and the privacy policy of the whisp.IO client (linked to on the opt-in page for the whisp.io text message sequence). If a consumer wants to opt-out of receiving messages, the consumer can text “STOP” at any time and the consumer’s information will be removed from Whisp.IO servers (if retained) and a removal transmission will be initiated into the system of Whisp.IO clients for removal of the consumer data.

Data Storage

Data obtained by Whisp.IO from its text messaging system is transferred directly to Whisp.IO clients. Whisp.IO does not retain any consumer data. Data protection is performed by Whisp.IO clients and information on that data protection can only be obtained from Whisp.IO clients.

How do I incorporate Whisp on my Website or Social Media?

How does the Customer receive their information?

The customer will receive the information directly to their phone.  Whether it be product information, a business card, a coupon, or an image, it will be sent directly to their fingertips.

You can receive the Customer’s information straight to your inbox or use one of our many CRM integrations to send it directly through your Customer Journey.
